These Mobile Terms of Service (“Mobile Terms”) govern your participation in SMS text messaging and mobile push notification programs (“Mobile Services”) offered by Healthy Way, Inc. (“Healthy Way” “we,” “us,” or “our”). By opting into our Mobile Services, you agree to these Mobile Terms as well as our Privacy Policy
and Website Terms of Service.
1. Consent to Receive Messages
By providing your mobile phone number and/or enabling push notifications within our mobile application, you expressly consent to receive:
- Transactional messages (e.g., order updates, delivery notices, account alerts).
- Promotional messages (e.g., exclusive offers, product announcements, reminders, health tips).
Consent is not a condition of purchase. Standard message and data rates may apply depending on your mobile carrier plan.
2. Message Frequency
Message frequency varies, but you can generally expect:
- SMS/MMS: Frequency to be dependent on your activity and preferences.
- Push notifications: Event-based or occasional promotional alerts when enabled in your app/device settings.
We strive to avoid sending excessive or redundant messages.
3. How to Opt Out
- SMS: Text STOP to any message from us to cancel. You will receive one final confirmation message.
- Push Notifications: Manage your preferences at any time through your device settings (iOS/Android).

5. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to participate. By opting in, you represent that you are the account holder or authorized user of the mobile number or device provided.
6. Data & Privacy
We respect your privacy. Message data (including phone numbers, message content, and metadata) is handled according to our Privacy Policy.
SMS programs are operated through Klaviyo, our marketing platform provider.
Push notification data (device tokens, engagement metrics) are collected via Klaviyo SDK integrations.
7. Carrier & Delivery Disclaimers
Mobile carriers are not liable for delayed or undelivered messages.
Delivery of SMS and push notifications may depend on device settings, carrier network availability, or app permissions.
8. Changes to Mobile Terms
We may update these Mobile Terms at any time. Updates will be posted to this page with a new “Last updated” date. Continued participation after changes constitutes acceptance.
